Uncle jailed for raping niece and beaten six times

SEREMBAN: A man has been sentenced to 26 years in prison after the Sessions Court found him guilty of raping his 14-year-old niece twice.

Judge Surita Budin also ordered that the suspect, who was 30 when the offenses were committed, be flogged six times.

“After assessing the evidence, the court concludes that the defense has failed to create reasonable doubt, while the prosecution has succeeded,” she said in her judgment on Friday (Nov 29).

The suspect was accused of raping his niece at a house in Sikamat. The first offense was committed around 2.30pm in June 2021 and the second around 12pm on July 2 that year.

In mitigation, defense attorney S. Kavitta said the accused, who was divorced, worked as a technician and had to take care of a five-year-old child.

‘In addition to caring for his sick father, he has also cared for his child on his own in recent years.

“We hope the court will impose a minimum prison sentence as this was his first offence,” she said.

Deputy Public Prosecutor Nurul Balkis Zunaidi, however, urged the court to impose a stiff sentence, citing the victim’s relationship with the suspect.

“She called him Pak Long, but he traumatized her for life by his disgusting actions. Instead of protecting the little girl, he raped her,” Nurul Balkis said.

Surita subsequently sentenced the suspect to 13 years in prison and three strokes of the cane for each charge, to be served consecutively.

The judge said the court took into account the public interest and the serious, heinous crime committed against a vulnerable child.

She also ordered a year of supervision for the suspect after his release.

Kavitta requested a stay of execution to appeal the ruling, but Nurul Balkis objected, stating that no special circumstances existed for this.

The court rejected the suspension, citing the lack of special circumstances and the primarily personal nature of the defense’s arguments.
