Big Question Mark Behind The Silent Attitude of the National Police Chief and the Attorney General

JAKARTA The espionage action carried out by members of the Special Detachment (Densus) 88 against the Deputy Attorney General for Special Crimes (Jampidsus) has sparked wild speculation. If this continues, it is believed that public trust in law enforcement agencies will be further eroded.

Military police personnel guarding Jampidsus Febrie Adriansyah reportedly arrested a Densus 88 member. This happened after the Densus member stalked Jampidsus while he was dining at a restaurant in Cipete area, South Jakarta , Sunday (5/26/2024).

Febrie arrived at the restaurant with an aide and a military police motorcycle. He was recently placed under the control of the military police because Jampidsus was involved in major corruption cases, particularly mining.

So far, National Police Chief Listyo Sigit Prabowo and Attorney General ST Burhanuddin have not provided an official statement. However, Coordinating Minister for Political, Legal and Security Affairs Hadi Tjahjanto only responded briefly: “Maybe the news is confusing.”

Indonesia Police Watch (IPW) observed allegations of stalking of Jampidsus Febrie by members of Densus 88 some time ago. IPW suspects that this spying action is linked to the ongoing alleged mining corruption case.

As is known, Prosecutor Febrie is currently handling a mega corruption case in the trading system of tin products in the mining permit area (IUP) of PT Timah Tbk in Bangka Belitung, which cost the State 271,000 billion rupees.

Febrie also investigated other corruption cases that attracted public attention, such as the Jiwasraya, Asabri, Garuda Indonesia and BTS Kominfo cases.

“Surveillance is a surveillance method to obtain information or data about the people being monitored, and Densus 88 has an excellent ability to do this,” said IPW President Sugeng Teguh Santoso when contacted by VOI .

“It’s a bit surprising that what was monitored was Jampidsus by Densus 88. That means it’s something serious. Densus 88 definitely moved on orders from the highest level. Where is the level and s “It’s official or not, which needs to be discovered,” he added.

Sugeng further said that there were two main issues behind this harassment. Besides allegations of corruption, there is also a conflict over who should handle the cases.

According to information obtained by IPW, the Attorney General’s Office is very involved in processing mining cases. In fact, the mining case, Sugeng said, did not include the authority of the prosecutor’s office.

“Mining affairs are a criminal act that falls under the authority of the police, it is in the mining law. It is not the domain of Jampidsus, but the prosecution works there in terms of corruption,” said l man born April 13, 1966.

Not only does it spark wild speculation, but this case also has a long tail. Jampidsus Febrie was later reported to the Corruption Eradication Commission (KPK) for alleged state losses caused by the PT Gunung Bara Utama auction process at the Attorney General’s Office.

Civil Coalition Save the Mine (KSST) coordinator Ronald Loblobly said indications of state losses reached 9 trillion rupiah.

Densus 88 members monitor and spy on possible terrorist attacks or other networks that threaten the public or the country. The action of Densus 88 members who hunted down Jampidsus actually surprised the public, according to police observer from the Institute for Security and Strategy (ISESS) Bambang Rukminto.

“Densus also does not have the authority to make non-terrorist arrests or investigations. Because the main task is indeed to eradicate terrorism, like that,” Bambang said.

The same was also expressed by Nusantara Islamic University Law Professor Dr. Leni Anggraeni, SH, MH. He considered that there was something very urgent for Densus 88 to be sent to follow Jampidsus Febrie. However, since Densus 88’s main task is to verify reports of terrorist activities, this espionage action cannot be justified.

“The Densus 88 has exceeded its function, unless the prosecutor is involved in acts of terrorism,” Leni said.

Seeing the attitude of the Attorney General and the National Police Chief remaining silent in the midst of major public questions regarding this case is tantamount to letting a wave of speculation run wild.

Leni hopes that the National Police Chief will immediately clarify the actions of his members in order to restore public trust.

“This is because currently, the performance of the National Police is really being highlighted, and public confidence has started to decline significantly regarding several cases that have occurred, notably when the community requested legal protection against the Police,” he concluded.
