Susan Embert’s Dismissal Appeal Heads to Georgia Supreme Court

ALBANY, Ga. (WALB) – Dougherty County District Attorney Greg Edwards is taking his fight against the dismissal of the Susan Embert case to the Supreme Court.

In May, Susan was released after Judge Willie Lockette overturned her conviction. In 2019, Susan was found guilty of all charges she faced in relation to her husband Jake Embert’s death – which was initially ruled a suicide.

Oral arguments are scheduled to begin at 10 a.m. on Tuesday, December 10. Judge Lockette dismissed the case due to the speedy trial and jury conflicts, but Edwards said he plans to do everything he can to fight for justice.

Susan’s attorney, Jenn Hyman, said she is confident the Georgia Supreme Court will uphold the dismissal decision.

“Even if we have to go back to trial, we are confident that a jury will find Ms. Embert not guilty,” she said.

Susan still proclaims her innocence, saying she never killed her husband, Jake. The previously convicted criminal has been out of prison for 5 months. The state is asking for a new trial, citing several reasons, including the fact that there was not a “delay of more than nine years” in the prosecution of Susan’s case.

Hyman said that despite having freedom, Susan is not out of the woods yet.

“Obviously, it was life-changing for our client,” she said.

This was the same case with Rachel Embert, Jake’s daughter. She told me she trusts the state to get 10 years of justice for her father.

“What would I say to Susan? I pray that you get everything you deserve and deserve to spend the rest of your life behind bars,” she said.

Hyman said that after oral arguments, he hopes to get a ruling from the Supreme Court in the first half of 2025.
