The disgraced music mogul, 55, has been behind bars The Metropolitan Detention Center in Brooklyn since September after he was arrested for alleged racketeering conspiracy, sex trafficking and transportation to engage in prostitution. He has pleaded not guilty to the charges.

According to the Federal Bureau of Prisons (BOP), Diddy and other inmates at the facility, commonly known as MDCare only eligible to vote by absentee ballot, provided they have not been convicted. TMZ was the first to tell the story.

“Pretrial detention does not affect an individual’s right to vote,” a BOP representative told The Post on Tuesday. “This means that if the individual was eligible to vote before being taken into custody by the Federal Bureau of Prisons (FBOP), his right to vote will not change unless and until he is convicted.”

“Incarcerated individuals with pretrial status, or ‘not convicted of a crime,’ are eligible to vote but must use the absentee voting system,” the representative added.

As with all voters, inmates must be registered to vote with MDC before requesting an absentee ballot. But receiving and mailing a ballot behind bars comes with a few additional hurdles.

Incarcerated individuals “must use their home address as their ‘residential address,’ and not their jail address, when completing their voter registration application,” the BOP representative explained. “Once they are registered to vote, they must list the FBOP facility in which they are incarcerated on their absentee ballot as their ‘mailing address.’”

Federal prisons handle “incoming mail from a board of elections labeled ‘Official Election Mail,’ ‘Official Election Ballot,’ ‘Ballot Enclosed,’ or similar language identifying the contents of the envelope. An election ballot will be treated as special mail and the inmate will be asked to sign for receipt of the mail,” the official said. “However, other types of election-related mail are considered general correspondence.”

Outgoing absentee ballots will be “treated as special mail and will not be opened or inspected by FBOP staff,” they noted.

According to TMZ, convicted prisoners who lived in Maine, Puerto Rico, Vermont or the District of Columbia before being incarcerated can vote while incarcerated, thanks to a 2021 Executive Order signed by President Biden.

Before his fall from grace, Diddy made efforts to increase voter turnout, boosting his “Vote or Die” campaign.

Diddy has tried several times to be released on bail as he awaits his trial, which is tentatively scheduled for May 2025. A judge has denied all of the star’s requests.

That’s what federal prosecutors have alleged Diddy presented ‘freak-offs’ described as elaborate “sex performances that Combs arranged, directed, masturbated during, and often electronically recorded,” according to Diddy’s unsealed indictment. The hip-hop producer also allegedly gave people drugs to “keep the victims obedient and compliant,” the government alleged.

After being arrested by Department of Homeland Security agents and sent to MDC, Diddy has had a tough time prison food options.

Gastronomic issues aside, Diddy was able to enjoy a different kind of birthday treat: a phone call with his seven children. In a video posted by Diddy’s son Justin, 30, he and his siblings sang “Happy Birthday” to their incarcerated father over the loudspeaker.

“My birthday, I’m happy,” Combs told his children with surprising optimism. “Thank you for giving me this call. Thank you very much. I love you all.”

The phone call in Justin’s video is the first time the public has heard Diddy’s voice since his captivity.
