Presumed Innocent Episode 3 Recap: Who Wants to Meet Rusty?

Presumed innocent Episode 3, “Discovery,” begins with Rusty Sabich (Jake Gyllenhaal) still looking at the text that says, “YOU’RE THERE. I SAW YOU.” Rusty goes out to call the number and begs to know who it is. Nobody’s answering. Barbara Sabich (Ruth Negga) follows him outside. He shows her the message and admits that he was there that night. But not to kill her. She starts to cry and enters. At the pool, he looks at his phone and wonders what to do.

The episode then cuts to Rusty fighting with Carolyn Polhemus (Renate Reinsve) as she pleads, “Rusty, it’s not you.” He then exclaims: “You don’t know me and you don’t know what’s inside me”, before hitting her with a poker. He then shouts “Wake up Raymond” as Raymond Horgan (Bill Camp) wakes up from his dream.

Who wants to meet Rusty?

The person texting Rusty asks to meet him that afternoon. Rusty shows Raymond the text, saying it could be a trap or a reporter. Raymond scolds Rusty again for not telling him he was at Carolyn’s house the night of the murder. Rusty says he went there afterwards to work to try to win Carolyn back, but he failed.

Raymond wants Rusty to hand over the phone to the police. Rusty wants to find out who it is and what it is. Raymond asks if Rusty has an alibi for the night of the murder. But he’s clearly worried, insisting they don’t know the time of night Carolyn was murdered. When Rusty tries to come up with a different plan, Raymond just wants to wait until all the facts are in before Rusty starts coming up with answers.

Rusty can’t help himself and goes to meet the texter in an abandoned factory. This is Carolyn’s son, Michael (Tate Birchmore). He has photos and videos of Rusty that night. He insists that Rusty was the only one who went there. Rusty says that’s not true, because Michael was clearly there too. Rusty demands that Michael give the images and video to the police or to him. Michael has already handed them over to the prosecutor. Rusty tells Raymond that Michael is clearly troubled.

Is Tommy right about the case?

During a status conference for the case with Judge Lyttle (Noma Dumezweni), Nico Della Guardia (OT Fagbenle) makes it clear that they are also trying to prosecute Rusty for obstruction of justice. Raymond calls it a set-up. As they argue, the judge says the trial will be about evidence and the law, not schemes.

Raymond reminds Nico and Tommy Molto (Peter Sarsgaard) that they must hand over all the evidence. They insist that is the case. Tommy finally admits that they are still authenticating Michael’s photographs. The judge says they have to turn over the evidence to him and the defense by the end of the day so they can properly analyze it together. She warns Tommy not to hide any more evidence.

Later, Nico tells Tommy to drop the obstruction charge, as it will allow the jury to arrest Rusty without convicting him of murder. Nico worries that Tommy isn’t ready to try the case. Nico says they need solid evidence of murder to convict Rusty.

New addition

Raymond hired Mya Winslow (Gabby Beans) as his associate. He says that not only is she experienced and talented, but above all, she’s a woman their team needs. When they are alone, Mya asks Rusty if he loved Carolyn or if it was a matter of lust. She tries to construct his story in case he is called to testify. He remembers the first time he felt an emotional attachment to her, when she showed kindness and tenderness to a little girl in front of a case. Rusty says he would never have hurt her. Someone else did it.

Barbara loses her job

Barbara goes to work, but is harassed by journalists. Her boss Kate (Rosanna Arquette) asks Barbara to step back, partly so she can take care of herself, but mainly to keep her distance from the art gallery. Barbara really wants to keep coming, calling it a necessary distraction. But Kate says it doesn’t work for them.

So Barbara goes to a local bar. She flirts with a bartender, telling him that she lost her job and that her husband is on trial for the murder of his mistress. She says he didn’t do it.

Lorraine doesn’t trust Rusty

At breakfast, having just reminded his wife Lorraine Horgan (Elizabeth Marvel) of the dream, she then tells Raymond that he clearly thinks Rusty is guilty. She is worried about her husband. If Rusty is found guilty, she knows he will have a hard time living with his best friend who will spend the rest of his life in prison. Even if he is found not guilty, Lorraine knows Raymond will always have the nagging feeling that Rusty really did it.

Barbara tells Lorraine about her flirting at the bar. She encourages Barbara to have a “little adventure”. Lorraine is delighted to see Barbara smile, calling her young and beautiful and telling her that she should feel this way every day. She even goes so far as to say that Rusty is no longer the man she married.

Rodriguez wants to help?

Tommy Molto screams at Det. Alana Rodriguez (Nana Mensah) for helping Rusty see Liam Reynolds (Mark Harelik) in prison. She insists Reynolds should be considered a suspect. Nico tells her that she is no longer involved in the case. She can see that they are dying for Rusty to be guilty.

Nico insists that their only goal is justice. But Rodriguez decides to remove the files on Bunny Davis’ murder to investigate it herself.

Later, Raymond learned that Rusty was looking for the second sperm sample in the Bunny Davis case. He warns that if they come up with the idea of a second suspect in Carolyn’s murder, they will be obligated to provide one. Rusty refuses to let go, saying that once the jury sees the brutal photos of Carolyn’s death, they will want someone to be to blame. If they can’t provide anyone else, they will blame him.

Family drama

Rusty tells his family that they are off to a good start with the case. But Jaden (Chase Infiniti) wants to know what evidence they have against him. He admits to his children that even though the evidence is all circumstantial, it points to him. Kyle (Kingston Rumi Southwick) asks if Rusty would plead to manslaughter, since he would only serve eight years in prison. Rusty, upset, tells Barbara Kyle that he clearly thinks he did it. She says he’s just terrified. Rusty asks Barbara if he should take the plea deal. She says no one in the family thinks he should do that. Kyle tearfully apologizes to Rusty.

The episode ends with Rusty looking at Michael’s photos and videos. This shows them happy. But in the last one, there’s a shot of Kyle riding his bike in front of the house that a dismayed Rusty focuses on.
