Parliament to consider IEBC Bill in line with Supreme Court ruling

The National Assembly is expected to consider the Independent Electoral and Boundaries Commission (Amendment) Bill and the Statutory Instruments (Amendment) Bill following the Senate’s proposed amendments.

The IEBC Amendment Bill, co-sponsored by majority party leader Kimani Ichung’wah (Kikuyu) and minority party leader Opiyo Wandayi (Ugunja), seeks to make consequential amendments to the IEBC Act. the Independent Electoral and Boundaries Commission (IEBC). 2011.

Specifically, the bill seeks to bring the law in line with Supreme Court judgments following the recently contested general elections.

The Court, in its decision, held that certain provisions of the law were unconstitutional, thus justifying the adoption of a new law to remedy the harm caused by the elections.

Additionally, the Statutory Instruments (Amendment) Bill, 2023, sponsored by the Majority Party Leader, seeks to introduce amendments to the Statutory Instruments Act, 2013, establishing deadlines for the development regulations aimed at ensuring effective implementation of parliamentary laws.

While delivering the message from the Senate, the Speaker of the National Assembly, Moses Wetang’ula, said the Senate had completed its role in passing the bills.

“Members, pursuant to the provisions of Standing Order 41(4), I wish to report to the House that I have received five messages from the Senate regarding the adoption of five Senate bills and two Senate bills. the National Assembly,” Wetang’ula said.

President Wetang’ula added that on June 11, 2024, the Senate considered and passed the Statutory Instruments (Amendments) Bill (National Assembly Bill No. 2 of 2023) and the Bill on the Independent Electoral and Boundaries Commission (Amendments) (National Assembly Bill No. 2 of 2023). 10 of 2024) with modifications.

The two bills were then referred to the Delegated Legislation Committee and the Justice and Legal Affairs Committee respectively for consideration.

“Aware of the nature of the Independent Electoral and Boundaries Commission (Amendments) Bill, I direct that the Justice and Legal Affairs Committee expedite the process and table its report on Thursday, June 20, 2024 at the during the morning session,” ordered the president. .
