Central government enacts Public Examinations (Prevention of Unfair Means) Act to curb malpractices

NEW DELHI: In a significant move to address growing concerns over malpractices in public examinations, the central government has formally notified the public examination body (Prevention of unfair means) Act of 2024. The legislation aims to prevent unfair practices in recruitment and Entrance exam. Such as NEET JEE and CUET, across the country. The development follows recent controversies, including allegations of malpractice in the UGC-NET and NEET exams.

The law passed earlier this year focuses on curbing paper leaks and other unethical activities during various exams, including those conducted by UPSC and SSC. According to an official notification from the Ministry of Personnel, public grievances and pensions came into effect from June 21, 2024.

Union Education Minister Dharmendra Pradhan reiterated the government’s commitment to protecting the interests of students, stressing that there would be no compromise on transparency. “The government is dedicated to protecting the future of students. We assure you of a transparent process to protect your interests and have confidence in the government and the system,” he said.

THE Public Examinations (Prevention of Unfair Means) Act was introduced in Lok Sabha on February 5, 2024. It was passed the next day. It received approval from the Rajya Sabha on February 9, 2024. President Droupadi Murmu gave his assent that month. Make it a law.

Under the new law, those found guilty of leaking exam papers or falsifying answer sheets face a minimum prison term of three years. Extendable to five years with a fine of up to Rs 10 lakh. Additionally, those involved in organized crimes review. Including officials of examination authorities. Service providers or other institutions can be sentenced to imprisonment ranging from five to ten years and fines ranging from Rs 1 crore.

This legislative measure takes on added importance in the context of the current controversy over UGC-NET 2024 exam paper leaked. The Central Bureau of Investigation (CBI) has registered a case to investigate the leak. This reflects the government’s serious stance on tackling examination malpractices.
