Proposal for severe sanctions for unfair means

The Uttar Pradesh government proposes to promulgate an ordinance to prevent unfair means. In a notice issued, the government mentioned that it is proposing to pass the Uttar Pradesh Public Examinations Ordinance, 2024 following paper leak of Police Constable Recruitment Examination and of the RO-ARO exam in the state.

The proposal, which was approved by the State Cabinet, would provide for life imprisonment and a fine of up to Rs 1 crore for the guilty. The notice said: “In exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, for the purpose of preventing unfair means, leakage of paper in public examinations, Prohibition of Solver Gangs and for matters connected therewith and incidental thereto, the Uttar Pradesh Public Scrutiny Promulgation of the (Prevention of Unfair Means) Ordinance, 2024, is proposed.

Further, he said that the said examination authorities like Uttar Pradesh Public Service Commission, Uttar Pradesh Subordinate Services Selection Board, Sub Board, University, authority or body or institution designated by them are also included. In addition, the extension of the said law will also apply to public service recruitment exams, regularization or promotion exams and entrance exams for diplomas, certificates or school certificates.

Under this, circulation of fake questionnaires, creation of fake employment websites and others are also punishable offenses. In case of violation of the provisions of the Act, a minimum punishment of two years to life imprisonment and a fine extending up to one crore rupees have been prescribed.
