D.C. Superior Court Judge Heidi Pasichow granted a defense attorney’s request that her client have more time to consider a plea offer while waiting for surveillance footage from the crime scene.

Darius Thomas, 27, is charged with unlawful possession of a firearm with a prior conviction more than one year old, carrying a pistol without a license outside a home or business, possession of an unregistered firearm and unlawful possession of ammunition. The charges stem from his alleged involvement in a non-fatal shooting that occurred March 25 in the 3700 block of 10th Street on the Northwest Side.

At the June 28 hearing, defense attorney John Machado asked Judge Pasichow to set a deadline for Raymond Elementary School to provide subpoenaed surveillance footage captured during the incident. The facility is located in the 900 block of Spring Road, NW, near the shooting scene.

The school did not respond to a subpoena, an issue Judge Pasichow agreed to address at the next hearing.

Machado also asked for a return date so the court can take action if the school does not comply.

According to arrest documents, a witness at the scene told Metropolitan Police Department (MPD) officers responding to a call of shots fired that the suspected shooter got into a white Acura SUV with two unidentified individuals. Police stopped the vehicle and reportedly found Thomas carrying a handgun in his jacket pocket.

Court documents indicate the scene of the incident took place near a recreational facility housing school-age children.

The holidays are expected to return on August 2.
