A man alleges his workplace charges employees $10 a day for parking, raising questions about whether an employer can legally do so.

TikTok creator Fulltime Warehouse (@fulltimewarehouse) discussed the scenario in a video that has generated more than 283,400 views since Monday.

In this video, an on-screen caption tells the gist of the story, although the video of the wide-eyed man nodding also helps to emphasize the message.

The caption reads: “My reaction to finding out we were forced to pay a daily $10 parking fee for employees or be fired.”

Although the video is short, it raises an interesting question posed by one commenter: “This MUST violate some sort of labor law, right?”

Does this violate any labor laws?

According to a 2019 Findlaw article, charging employees for parking is legal, even if it may seem unfair.

Specifically, the article notes: “No section of labor law requires employers to provide any type of parking for employees, much less free parking.”

But the article adds with a hint of irony: “Of course, offering such benefits is advisable for an employer who wants to keep his employees satisfied. But not all employers care about such things.”

One of the points raised in the article is that the employer might not own the parking lot used by employees.

“If the employer leases its parking to a third party, it may make more sense for the employer to ask employees to pay for their own parking,” he notes. “Charging employees to park on employer-owned property may seem distasteful, but employers may argue that the fees are used to maintain the parking area.”

The article adds that it might make a difference if you are a disabled employee.

“The Americans With Disabilities Act requires employers to provide benefits such as parking. If, however, an employer does not provide parking for all of its employees, it generally is not required to provide parking for employees with disabilities.”

Commenters reacted to the revelation about the unidentified workplace.

“So $10 times 20 days a month…$200 a month?” someone asked, flaunting their math skills. “Unless you’re making really good money, that’s a huge percentage of every paycheck. It can’t be worth it.”

Another observed: “Brother needs to stand up for himself and call them out on their bullshit and if they want to fire him they’ll have to find a valid reason other than disrespect.”

One commenter pointed out: “I don’t like unions, but this is a perfect example of why a union is a good thing.”
