Lawyer accused of murder calls for review of DPP’s decision – FBC News

The Office of the Director of Public Prosecutions has decided to file a ‘no case’ following the ruling against two brothers accused of murder, conspiracy to assault a lawyer and his partner, indecently annoying, property damage and attempted murder.

The DPP decided to file the no-case to account for Chote and Jowahir Lal as there was insufficient evidence.

However, a lawyer accused of alleged murder has filed an application for review of a DPP decision.

The case was heard today by Judge Savenaca Banuve at the Civil Court in Labasa.

The lawyer, Amrit Sen, retained Simione Valenitabua to represent him in the case.

Sen is accused of causing the death of John Rusiate in June 2022 when he allegedly ran over the victim with his vehicle, causing fatal injuries.

Sen denied the claim in court and maintains his innocence.

He faces one count of murder, seven counts of attempted murder, two counts of assault and one count of criminal intimidation and conspiracy to pervert the course of justice.

Valenitabua argued that justice may not be served for Rusiate’s death if the brothers are acquitted.

He also said the investigation was still ongoing when the DPP filed a no-case for the two brothers.

He said there are concerns that crucial evidence is being overlooked or suppressed.

Valenitabua said his client, Sen, was innocent compared to the two brothers.

The case has been adjourned, but the court has not given an exact date for the next hearing.
