Man sentenced to life in prison for murdering son because he refused to call stepmother 'ammi'

Mumbai: Taking note of the apathy of bystanders and neighbors who failed to intervene when a Dongri man was stabbed with a pair of scissors by his father, a sessions court on Monday sentenced the 49-year-old parent to life imprisonment for murdering the 20-year-old victim in 2018 for refusing to give his stepmother “ammi “(mother).
While finding the accused, Salim Ali Shaikh alias Madrasi, guilty of murdering Imran Shaikh, Judge SD Tawshikar said it was really worrying that even though the incident took place around 9.30 pm in a busy part of the city, no one volunteered to provide assistance. information to the investigating officer.
“The act of the mother running to the police station to seek police assistance shows her helplessness and the apathy shown by neighbors and bystanders to provide timely assistance to the deceased. This shows the declining standards of our society and the careless attitude towards such a serious matter.” incident,” the judge said.
Imran’s biological mother, Parveen Shaikh, told the court that she had named the father as a suspect out of anger and that her son was under the influence of drugs and had stabbed himself. She also claimed that after her son started fighting with the suspect, she rushed to the police station. The judge noted that her testimony about self-inflicted injuries appeared unreliable and was an attempt to save her husband. Calling her an unhappy woman, the judge said: ‘She seems stuck in an emotional dilemma. On the one hand, she has already lost her child, and on the other hand, her husband is in danger of being punished for committing the murder. of their son. So she tried to get rid of some things wrongly.”
The judge refuted the suspect’s defense that he was falsely implicated, noting that the suspect was the victim’s father, but showed no sympathy for him. “After the assault, he appears to have run away from the scene. The lady who assisted the police in taking the injured to hospital is said to have died during the course of the trial. Records show that the suspect was not present at the hearing “On the spot after the incident nor a visit to the hospital. This unnatural behavior of the suspect must also be taken into account,” the judge said.
The judge emphasized the brutality of the crime and stated that the use of a sharp weapon such as scissors indicated a deliberate and cruel act. The father, who had a history of conflict with his son, argued that the killing was the result of sudden anger. The court rejected this claim, citing the severity of the attack and the father-son relationship.
Although the prosecutor sought the death penalty, the judge reasoned that the maximum sentence could not be imposed. “Although the prosecution is right in saying that causing the murder of one’s own son is itself a rare case, this does not fit into the ‘rare’ category set out by the Supreme Court,” the judge said. .
The eleven witnesses named by prosecutor Ajit Chavan included two eyewitnesses who tried to break up the first fight between father and son. They did not fully support the prosecution’s case. Referring to their evidence, the judge said: “The cumulative effect of the statement of these three witnesses unerringly establishes that on the date of the incident there was an argument between the accused and the deceased Imran. They were seen fighting. The suspect attacked Imran. Thereafter, the deceased is found dead within a short span of 15 to 20 minutes. “The suspect cannot therefore explain how the deceased sustained the injuries; someone else would attack the injured in such a short period of time.”
