Delhi court convicts man of raping woman in 2018 – ThePrint – PTFeed

New Delhi, Oct 26 (PTI) A court here has convicted a man for repeatedly raping and impregnating a 19-year-old woman in 2018, saying it can be safely concluded that there was no consent from the victim.

Additional Sessions Judge Preeti Parewa was hearing a case against a man accused of rape, kidnapping and criminal intimidation of the victim.

In its 46-page judgment dated October 8, the court, after taking note of the evidence before it, said: “It can be safely concluded that there was no consent of the victim and that the accused had repeatedly had sexual intercourse with the victim. without her consent.” It said there was nothing on record to show that the accuser had any motive to falsely accuse the suspect and that the victim’s uncontested testimony was corroborated by her mother’s version.

“Moreover, the victim’s naivety can be inferred from the fact that, after complaining of abdominal pain, she visited a hospital with her mother, where she was told that she was five months pregnant. This fact also reflects the ignorance and lack of knowledge of the victim and her family,” the court said.

According to the DNA investigation report, the suspect was the biological father of the child.

The court noted the victim’s testimony and said she was forced by the suspect to go to a secluded room in a park, where the suspect repeatedly raped her. He also threatened the complainant saying that if she told the same to her mother, she would be driven out of her house.

It said: “The court cannot turn a blind eye to the sections of society to which the victim belongs while appreciating her testimony. The amalgamation of guilt and shame is the main reason for fear generated in the mind of the victim in our society, and the vulnerability of such a victim should also not be overlooked.” Underscoring that the prosecution had successfully proven its case against the suspect, the court said that the suspect “had abducted the victim with the intention of enticing her into illicit sexual intercourse, raped her three to four times, resulting in her pregnancy and the birth of a child.” female child and also criminally intimidated her”.

It then convicted the accused under sections 376 (rape), 366 (kidnapping, kidnapping or inducing a woman to force her marriage, etc.) and 506 (criminal intimidation) of the Indian Penal Code (IPC).
