RNC calls for Supreme Court to intervene in Pennsylvania voting case

The Republican National Committee (RNC) asked the Supreme Court on Monday to weigh in on a ballot case in Pennsylvania, arguing that the state’s Supreme Court “misread” election law.

The Supreme Court of Pennsylvania ruled last week that voters can still cast their provisional ballots in person in November if mail-in ballots are rejected for not following procedural directions, such as not bringing required secrecy envelopes, which voters must sign and date.

The RNC claimed the court misread state law, which says a “provisional ballot shall not be counted” if the ballot was received by county election officials in a timely manner.

“When the Legislature says certain ballots can never be counted, a state court cannot always blue-pencil that clear order,” the RNC legal team wrote in their application. “This is where the General Assembly could not have been clearer.”

The request went Monday to Supreme Court Justice Samuel Alito, who hears emergency cases from Pennsylvania. Alito instructed the other parties to respond to the RNC by Wednesday.

The request comes after more than 1.4 million ballots have been returned so far this year. De Heuvel reports this. It also comes just over a week before the 2024 presidential election, in which Pennsylvania is considered a critical swing state.

The RNC has asked the Supreme Court to rule by Friday. If it cannot meet that deadline, the party has asked for the disputed ballots to be counted separately.
