Musk avoids court appearance and tries to get PA lawsuit over  million giveaways moved

Elon Musk did not appear in court Thursday for a previously scheduled hearing stemming from a lawsuit involving the giving away of more than $1 million.

Democratic Philadelphia District Attorney Larry Krasner filed a lawsuit Monday seeking to stop what he described as an “illegal” lottery run by Musk’s America PAC.

Musk’s sweepstakes has awarded a daily prize of $1 million to registered voters in swing states who sign his political action committee’s petition in support of the First and Second Amendments to the U.S. Constitution.

Musk, who has been an outspoken supporter of former President Donald Trump this election cycle, was ordered to appear in court for a hearing on Thursday, but on Wednesday evening his lawyers filed a motion to move the case to federal court.

“We’ll go to federal court and we’ll argue the issues there and try to get the case moved back to state court,” said attorney John Summers, who represents the district attorney.

Lawyers for Musk have not commented publicly on the case.

Meanwhile, America PAC continues to hand out checks. A photo of winners from North Carolina was posted Thursday, noting that a new winner will be selected every day until Election Day.
