Deficiencies in the termination process: Employee cites employer’s failure to provide notice

Although the employer pointed out a concerning pattern of behavior, the employee continued to maintain that she was denied basic procedural rights during the dismissal process.

Background to the case

The employee started at the Yandina Hotel in December 2016 as a casual kitchen assistant, before the current owners took over in July 2017.

Over almost seven years, she rose to manager of the bottle shop, working regular shifts of around 30 hours a week, spread over six days.

As manager of the bottle shop, she supervised several employees, including store clerks. She gave work instructions both in person and via a staff Facebook page. The general manager supervised her work.

In mid-2024, two employees separately raised serious complaints about the the employee’s behavior in the workplace. They said she used threatening behavior, intimidation tactics and foul language.
