According to the Bexar County Criminal District Attorney’s Office, on July 17, 2020, two San Antonio Police Department (SAPD) officers responded to a domestic violence call at a North Side apartment complex involving Foster.

When officers arrived to investigate the situation, Foster began shooting at them. He fired a total of 17 times with a pistol and 5 times with a shotgun. Officers returned fire and managed to subdue him.

After the sentencing and while being transported to jail, Foster jumped out of his wheelchair and ran several blocks before he was caught. He now faces an additional charge of escape.

Bexar County District Attorney Joe Gonzales said in a press release:

We support our San Antonio police officers and are grateful that these officers were not harmed. Our office will continue to seek justice for all crime victims, especially those who risk their lives every day to keep our community safe.
