COLORADO SPRINGS, Colo. (KKTV) – On Tuesday, Colorado’s 4th Judicial District ruled that an officer-involved shooting on May 18 in Colorado Springs was justified.

Officials said that on May 18 around 10:36 p.m., a woman called 9-1-1 and said her adult son, 40-year-old Michael Hurst, was using meth and acting erratically. The mother also said Hurst was paralyzed and had a gun.

While speaking to 9-1-1, officials said the mother snuck out a window and got outside Hurst.

When Colorado police officers arrived, they made announcements urging Hurst to leave the house, which he failed to do. Officials said police deployed a drone to the home to spot Hurst and make sure he was alive.

“Once the drone was above, officers heard shots and breaking glass,” the prosecutor said. The drone lost connection and crashed.”

Officials said CSPD officers continued to urge Hurst to leave the house for 40 minutes, and eventually Hurst walked onto the porch armed with a rifle.

The prosecutor said officers asked him to drop his gun, but Hurst refused, telling officers, “F*** you, officers.” I shot down your drone,” and threatened to shoot and kill police if they advanced.

“(CSPD) Officer Cassalia, fearing for his safety, the safety of fellow officers on scene and the community at large, fired his service weapon four times, striking and killing Mr. Hurst Jr.,” the office said of the public prosecutor.

Prosecutors said they determined that CSPD Officer Nicholas Cassalia’s deadly use of physical force was justified and that no charges would be filed.
