Marion County mother is filing a federal lawsuit, challenging how schools interpret the state’s endangerment law

MARION CO., Tenn. (WSMV) – A Marion County mother has filed a federal lawsuit challenging the way Tennessee school districts interpret the state’s school endangerment law.

The lawsuit alleges that the school district violated her son’s First and 14th Amendment rights.

The woman’s 14-year-old son was arrested and expelled from school for allegedly using the word “bomb” in class.

The boy allegedly told a classmate to “stop tapping that pencil before I bomb you” while in English class. The teacher overheard the interaction and sent him to the principal’s office.

The 14-year-old was accused of threatening mass violence on school grounds.

The lawsuit claims the punishment was a “knee-jerk” response and excessive.
