Troy man pleads guilty to organized crime theft but avoids jail time due to medical condition

PITTSFIELD, Mass. – Angel Nunez, 57, formerly of Troy, NY, pleaded guilty Tuesday to 15 charges stemming from his involvement in an organized theft ring that targeted Berkshire Bank locations last year.

Nunez admitted that he attempted to make fraudulent ATM withdrawals during three visits to Berkshire Bank branches on June 23, June 26 and July 10, 2023. He entered his plea in Berkshire Superior Court, where the Honorable Judge John Agostini presided over the case.

The Berkshire District Attorney’s Office sought a two-year sentence in the House of Corrections, while Nunez’s defense team sought house arrest on the grounds of a serious medical condition. Judge Agostini sentenced Nunez to two years’ probation on the condition that he commit no new crimes.

Prosecutors revealed that Nunez’s medical condition was a key factor in the sentencing decision because the House of Corrections does not have the facilities to provide the necessary level of care.

Nunez’s guilty plea and unique sentencing underscore the challenges the criminal justice system faces in balancing punishment with medical and humanitarian considerations.
