Kalispell man serving a suspended sentence for rape charged again with sexual assault

Nov. 16 – A convicted rapist who was given a suspended sentence in Flathead County District Court in 2023 now faces the same charges in Lake County.

Fabian Alexander Perez-Calderon, 25, pleaded not guilty Nov. 13 to one misdemeanor count of sexual intercourse without consent in the 20th Judicial District Court, which covers Lake and Sanders counties. He remains in the Lake County Jail on $50,000 bond.

Prosecutors accused Perez-Calderon of raping a woman he met on Facebook. The victim, who turned himself in to authorities in March 2024, told investigators that the two had arranged to meet offline, according to court documents. Perez-Calderon allegedly agreed to bring alcohol.

When they came together, Perez-Calderon aggressively tried to kiss the victim, according to court documents. She asked him to leave, a request she believed he had complied with.

While she was in bed moments later, the victim looked up and saw Perez-Calderon allegedly standing naked in her room. He grabbed her hair, prompting her to cry and tell him he was hurting her, according to court documents.

“Don’t you find me attractive?” he reportedly asked her before taking off her shorts. Perez-Calderon placed his hand on her throat and hair before raping her, court documents said.

Perez-Calderon remains on probation for a rape conviction in Flathead County District Court. In March 2023, Judge Robert Allison gave Perez-Calderon a ten-year suspended sentence for allegedly raping a woman in a car after a bonfire party in 2022. He was also designated a level one sex offender and ordered to undergo sex offender treatment .

Allison simultaneously gave Perez-Calderon a five-year suspended sentence in an unrelated case dating back to 2021. In that case, Perez-Calderon was accused of hitting and hitting a man with a skateboard. Allison ordered him to pay $4,149.52 in restitution to the victim.
