Postponement of the extradition of the Ndimande brothers

The case against the five suspects returned to the Durban Magistrate’s Court on Friday.

Prosecutors have been granted a permanent extension until February so they can complete and issue charges against the suspect.

At the last action in August, the State requested a long-term postponement, including pending the outcome of the extradition request in eSwatini involving two accused brothers.

On Friday, the court heard that there were developments in the neighboring country.

The Ndimande brothers had decided to appeal the ruling granting the extradition request.

Prosecutors in eSwatini took the case to the Supreme Court, arguing that the notice was not filed on time.

Their request to have the notice annulled was rejected this afternoon.

In Durban, after hearing the outcome of the eSwatini High Court’s application, prosecutor Lawrence Gcaba asked for the case to be adjourned until next year for the outcome of the appeal and finalization of the indictment.
