Mobile grand jury to consider murder charge against Dan Williams Road shooting suspect

MOBILE, Ala. (WALA) – A grand jury will consider a murder charge in the Theodore shooting.

A judge determined prosecutors had sufficient evidence to present the case against Ervin Payne. Prosecutors allege he fatally shot Jerry Frison, 52, on Dan Williams Road on May 2. Officers found the victim in the front yard of a residence.

Witnesses told FOX10 News at the time that the victim was speaking with a man in a truck who left only to return a short time later and shoot the Friesian several times.
