Heritage Foundation vows to prevent Democrats from replacing Biden

The Heritage Foundation has pledged to do everything possible to prevent Democrats from replacing the president Joe Biden as the party’s candidate for president.

About four months ago, the conservative organization began studying state laws for replacing candidates in key states, according to a NOTUS report. Heritage Project staffers wrote the report in April and released it ahead of the debate.

“If the Biden family decides that President Biden will not seek re-election, the mechanisms for replacement on ballots vary by state,” the memo reads. “There is a risk of pre-election litigation in some states that would make the process difficult and possibly unsuccessful.”

The Executive Director of the Organization’s Monitoring Project Mike Howell said in a statement to NOTUS that they would make the process of replacing Biden “extraordinarily difficult.”

“We have targeted a few states that we believe are the most favorable,” Howell told the outlet without naming the specific states. The memo, however, identifies Nevada, Washington and Georgia as the states most likely to use the legal route to prevent a new Democratic candidate from replacing Biden on the ballot.

“It all depends on when and how they do it,” Howell added. “And then what state we’re looking at right now to match up with, go in there and work with the right people.”

“The problem that any potential replacement for Joe Biden would likely face is that in many states, including several key swing states, the deadline to run for office has already passed,” he said. Zack Smitha senior lawyer at Heritage, in a statement to NOTUS. “Or in many states, the process for replacing a candidate currently on the ballot is simply not clearly defined because it happens so rarely.”
