Dorchester man charged with taking upskirt photo of 11-year-old girl

BOSTON, July 2, 2024 – A Dorchester man was arraigned Monday at Dorchester BMC on charges he took an “upskirt” photo of an 11-year-old girl as she walked to a bus stop last month, Suffolk District Attorney Kevin Hayden said.

AGUSTIN JARAMILLO, 28, was charged with assault and battery on a person under 14. Judge Thomas Kaplanes ordered Jaramillo held on $500 bail. Jaramillo is scheduled to return to court on Sept. 24 for a preliminary hearing.

On June 6, Boston police responded to a call from Conservatory Lab Charter School in Dorchester. Officers encountered an 11-year-old student who reported to school staff that she had been approached by a man, later identified as Jaramillo, as she walked to the bus stop that morning.

Jaramillo handed the victim a rope and asked her to help him tie a knot. He then leaned over and told the girl he was going to pull her sock up. Jaramillo then used his cell phone to take a photo up the victim’s skirt and rubbed his hand against her leg. The girl described Jaramillo as a man in his 30s, with a mustache, carrying a white plastic shopping bag and wearing a black T-shirt and white shorts.

Investigators reviewed video from several neighborhood surveillance cameras and observed a man matching the description interacting with the victim on Wainwright Street. Police released photos of the suspect.

On June 27, investigators received a message via Facebook Messenger that identified the man in the photos as Jaramillo. Police issued an arrest warrant for Jaramillo on June 29.

“This young girl deserves credit for telling school officials what happened to her that morning. That information, along with the valuable assistance of a community member, helped police make an identification and arrest. This is another example of the community working with law enforcement to increase safety for all,” Hayden said.

All persons charged are presumed innocent until proven guilty beyond a reasonable doubt.
