“Consider transferring the teacher who applied 3 days before Utsashree portal was suspended”

Soumyadip Mullick, MP, July 22, 2024, Kolkata: The Calcutta High Court has directed the state to consider transferring a primary school teacher on medical grounds who had submitted her application online three days before the Utsashree portal was suspended.

It has been learnt that the applicant had applied for general intra-district transfer on medical grounds. The transfer application was submitted on the Utsashree portal on 26th September 2022. The portal has been suspended with effect from 29th September 2022.

No step was taken to consider the transfer application filed by the petitioner. The court observed: “As it appears that the transfer application of the petitioner is pending before the District Primary School Board, Purba Bardhaman, therefore, the Board is directed to consider the said application and take a decision in accordance with law at the earliest but positively within a period of four weeks from the date of communication of this order.”

In the meantime, the court ordered the applicant to resubmit a copy of the transfer request to the said authority for consideration of her request.

It was learnt that the applicant Rumpa Dutta received an appointment letter from the District Primary Board, East Burdwan for the post of Assistant Teacher (Primary) in a school on 06.07.2010. Thereafter, on 12.07.2010, the applicant joined the school.

As she had to travel a long distance and was suffering from gynaecological disorders, she requested her intra-district transfer in 2022 on medical grounds which were not taken into consideration.

One of the grounds on which the application was filed was that the applicant had requested a transfer for special reasons (self-medicating reasons), which is the issue of the applicant’s right to life.
