High Court refuses to cancel bail of man accused of rape of minor

Bhopal/Jabalpur: The Supreme Court of MP asked the state government to be cautious in filing applications cancellation of deposit Justice Sanjay Dwivedi has rejected the government’s request to cancel bail granted to a man accused of raping a minor.
The government has asked the court to cancel the bail granted by the High Court to a accused of rapecharged under the Pocso Act and the Indian Penal Code. During the hearing of the application, the court noted that the accused had been granted bail by the High Court in July 2022 in a rape case registered at Churhat police station in Sidhi district.
The government argued that the accused had committed a crime after his release and proceedings had been initiated against him under sections 323, 294, 506 and 34 of the Indian Penal Code. He had therefore misused the liberty granted to him by the court and violated section 437 of the Indian Penal Code, the petition said.
The Supreme Court, citing the verdicts of the Supreme Court and high courts, said that a decision to cancel the bail of an accused should not be taken mechanically. The court should take into consideration the crime allegedly committed earlier for which bail was granted, and the crime allegedly committed after bail, and whether the crime committed after grant of bail was committed to avoid punishment for the earlier crime.
The court, while rejecting the government’s request, urged caution in handling requests for cancellation of bail granted to an accused.
