Victory for Plaintiffs in Dr. Lanzer Class Action LawsuitMaddens Lawyers Dr Lanzer’s class action plaintiffs won a significant victory in a recent trial in the Supreme Court of Victoria. In May 2024, the plaintiffs sought to file a proposed amended pleading, which document forms the basis of their case against the defendants.

Defendants made several requests to strike portions of plaintiffs’ claims. At a two-day hearing in July, the plaintiffs were successful in defending against these requests and the Court has now approved the plaintiffs’ submission of amendments to their claim.

As Judge Forbes stated in her ruling issued on October 2, 2024: “Since September (Statement of Claim) the questions in the group proceeding have been reasonably clear to the Court and capable of being answered by the defendants in their defenses.” The court’s decision allows the plaintiffs to seek damages for disappointment and distress and to pursue their claims that the plaintiffs were misled by the defendants’ social media on the Lanzer website and by the defendants’ statements that the defendants were specialized surgeons with training specialized surgery. .

His Honor noted at trial that “(e)ach doctor admitted that he did not have qualifications in plastic surgery”.
