India News | HC asks Mira-Bhayandar civic body to consider fresh plea on animal slaughter for Bakri Eid

Mumbai, Jun 13 (PTI) The Bombay High Court has directed the Mira Bhayandar Municipal Corporation (MBMC) to consider a fresh plea seeking permission to slaughter animals during the Bakri Eid festival.

The court on Friday ordered the company to make a decision by noon on June 16.

On June 10, the MBMC animal husbandry department canceled the temporary permission granted to slaughter sacrificial animals during the festival.

The civic body revoked its June 5 order allowing the felling after looking into the local police’s claim that it could lead to a law and order problem in the area.

Following this, the petitioner, Rizwan Khan, approached the High Court seeking a stay on the civic body’s decision to cancel the felling permission.

A division bench comprising Justices Shyam Chandak and Revati Dere noted that mere issue of public order cannot be a ground to cancel the permission, which the company had granted on June 5.

“However, during the course of discussion, we noted that the permission was not granted strictly in accordance with certain laws/rules, and particularly Section 6 of the Maharashtra Animal Preservation Act, 1976 and with the 1978 Rules,” the court said.

Considering the urgency of the matter, the court directed the petitioner to file a fresh application with the civic body for permission to slaughter buffaloes at a designated place.

“If such an application is made, taking into account the urgency, the competent authority concerned shall decide on the application/authorization for slaughter of buffaloes as soon as possible and in any event not later than June 16, 2024 “, says the text.

The bench directed the MBMC to examine all laws/rules relating to animal slaughter, including the provisions of the Maharashtra Animal Preservation Act, 1976.

The court said the decision had to be taken on June 16 before noon and the applicant had to be informed of it on the same day before 2 p.m.
