Center notifies law to prevent unfair methods in public exams

Synopsis

The law includes six chapters and 19 sections in total.

The Central Government has notified an Act to prevent unfair methods in public examinations and to provide for matters connected therewith or incidental thereto.

The Public Examinations (Prevention of Unfair Means) Act, 2024 received the President’s assent on February 12, 2024.

A gazette notification was issued by the Ministry of Personnel, Public Grievances and Pensions on Friday which said: “In exercise of the powers conferred by sub-section (2) of section 1 of the Public Examinations (Prevention of Unfair Means) Act, 2024, the Central Government hereby appoints 21st June, 2024, as the date on which the provisions of the said law will come into force.”

In accordance with Chapter III of the law, the offenses covered by the law are identifiable, cannot give rise to bail and cannot give rise to collective prosecution.

The law will be applicable to any examination carried out by-

1. Public Service Union Commission.
2. Personnel selection commission.
3. Railway Recruitment Boards.
4. Institute of Banking Personnel Selection.
5. Central government ministries or departments and their attached agencies and
subordinate offices for personnel recruitment.
6. National testing agency.
7. Any other authority as may be notified by the Central Government.
