Lawyer Plans to Sue Bus Company for Chile Crash Victims; says the same company involved in a similar crash in January

Bus company in Chile sued;’ The lawyer says the accident is very similar to the previous accident involving the same company

CHILE, NY — A bus accident in Chile on Thursday which injured 28 people — one of whom died – mimics another recent accident involving the same company, FlixBus. The company had another fatal accident in January in Lake George, north of Albany.

Edward Jazlowiecki, an attorney with Jazlowiecki and Jazlowiecki LLC, said he and three other attorneys represent all 16 passengers who were on the bus in the Lake George crash, including one person who died.

The driver in the Lake George crash received four citations: driving while fatigued, no seat belt, unsafe lane change and unreasonable speed.

“The bus goes off the road, comes back, turns on its side – mirror image of this – we know this guy fell asleep,” Jazlowiecki said.

The driver in Thursday’s bus crash on I-490 received the same four tickets. Jazlowiecki received a call about the crash Thursday morning.

“I said, ‘What are the facts?’ They said, ‘Very similar to the one we did in Lake George.’ I couldn’t believe it,” he said.

Jazlowiecki plans to represent people involved in the bus crash in Chile and says he would file the lawsuit in Texas, just as he did for the ongoing lawsuit for the FlixBus crash in Lake George in January, since FlixBus headquarters North America is located in Dallas.

When asked how the Texas tort law will affect compensation for victims here, Jazlowiecki said, “First, the accident happened in New York, so New York law will apply, rather than Texas law. ”

“Flix is very, very – let me just say they know what they are doing – they limit their liability by cutting corners on the companies they do business with. and the companies they deal with are small mom-and-pop companies – they usually have four or five buses – they only have $5 million in coverage on a single bus, which is ridiculous,” Jazlowiecki said.

As for the victims of the Chile crash, one passenger has died, four others were in guarded condition at Strong Memorial Hospital as of Friday evening and the rest are expected to recover.
