Supreme Court to consider hearing plea for restoration of Jammu and Kashmir State

On December 11, 2023, the Supreme Court unanimously upheld the revocation of article 370 of the Constitution, which granted special status to the former State.

The Supreme Court on Thursday said it will consider listing a plea seeking restoration of the time-bound state of Jammu and Kashmir.

Senior advocate Gopal Sankaranarayanan, appearing for the petitioners, urged a bench comprising Chief Justice of India (CJI) DY Chandrachud and Justices JB Pardiwala and Manoj Misra that the plea needed an urgent hearing.

”There is an MA (different application) to check State status. It was observed (in last year’s judgment) that there has to be a deadline,” the senior lawyer said.

“I will take care of it,” the CJI said.

The new application was filed by Zahoor Ahmad Bhat, an academician, and Khurshaid Ahmad Malik, a socio-political activist, in Jammu and Kashmir.

On December 11, 2023, the Supreme Court unanimously upheld the abrogation of Article 370 of the Constitution, which gave special status to the erstwhile state of Jammu and Kashmir, in 2019 and ordered that legislative elections be held there by September 2024. The court also said that the statehood of Jammu and Kashmir should be restored “as soon as possible”.
