Case against Cork man accused of dangerous driving causing death of 8-year-old boy postponed until next month

The case against a 61-year-old man accused of dangerous driving which caused the death of an eight-year-old boy more than a year ago in Carrigaline has called for an adjournment to consider the voluminous prosecution case.

Garda Dinah Birnbaum charged John Moynihan of Parkanillane, Kilnamartyra, Macroom, County Cork, last month with dangerous driving on Cork Road, Carrigaline, County Cork, causing the death of eight-year-old André Ladeiro on August 12, 2023 .

Sergeant Gearóid Davis indicated on 12 September at Cork District Court that the Director of Public Prosecutions had directed the trial on indictment at Cork Circuit Criminal Court and had also consented to a signed confession of guilt being tendered by the defendant for sentencing at the court of circuit.

Prosecution evidence was to be provided to the defendant’s lawyer, Seán Cahill, so that consideration could be given to a signed guilty plea if one arose.

On Thursday, defense lawyer John Colthurst said “a fairly voluminous file” had been provided to the defendant’s advisers to consider the matter. Colthurst said more time was needed in this regard and asked for the case to be adjourned until November 28.

Sergeant Dave Delea said the State would seek an earlier adjournment date to move the matter forward.

Judge Mary Dorgan refused to grant an early adjournment and said the defense should be given time to consider the position. The case was adjourned until November 28.

Moynihan was remanded on bail until that date at Cork District Court. To date, no evidence has been presented in court regarding the circumstances that gave rise to the accusation.
