Shane Roper files motions to dismiss charges and block evidence – ABC 6 News

(ABC 6 News) – Former Minnesota State Trooper Shane Roper has filed a series of motions with the court to dismiss 8 of the 9 charges against him.

Roper is facing multiple serious charges, including manslaughter and vehicular homicideafter he was involved in a crash outside the Apache Mall that killed 18-year-old Olivia Flores in May.

According to court documents, Roper chased a driver who had allegedly committed a traffic violation on Highway 52. ​​During the pursuit, Roper reportedly reached speeds of 130 mph without activating his emergency lights before turning onto Highway 14 and crashing outside the Apache. According to court documents, Roper wants to dismiss eight of the nine charges against him, claiming the state failed to show probable cause for the charges and failed to prove Roper’s alleged negligence causes Flores’ death.

The motion does not challenge Roper’s ninth charge: misdemeanor careless driving.

Roper’s defense is also seeking to block certain evidence at trial, including his prior record of speeding and on-duty crashes, and his dismissal from the state patrol.

The defense is also seeking a change of venue, saying a fair trial in Olmsted County would be impossible given the amount of local media attention on the case.

Roper’s next hearing is scheduled for Nov. 21.
