Man sentenced to 20 years RI for rape of minor

Mangaluru: The Additional District and Sessions Judge FTSC-II, Maanu KS, sentenced a man to 20 years of rigorous imprisonment and imposed a fine of Rs 50,000 for raping a minor survivor. The convict does Abutahir alias Shazil, 20, resident of B Kasaba village, Bantwal Taluk.
Special Public Prosecutor K. Badrinath Nairy stated that the convict had telephone contact with the survivor. On June 22, 2023, he asked her to meet him at Madanthyar in Parenki village. Accordingly, the survivor met Abutahir in Madanthyar. Later, he forcibly took her to Mangaluru Central Railway Station to travel to Goa. Abutahir then took her to an empty compartment of a train on platform number three and had sexual relations with her between 11:00 PM and 12:00 AM.
A missing case was registered at Punjalkatte police station. Around 12 noon, the survivor contacted her mother by phone from the train station. After this, the mother informed the police, who rushed to the train station. Police rescued the survivor and arrested Abutahir.
A case under Sections 363, 376(1), 376(3) of the IPC and the provisions of the Pocso Act was registered at Punjalkatte police station. The then police inspectors Shivakumar B and Nagesh K conducted the investigation and filed a chargesheet, Nairy said.
The court heard 17 witnesses and marked 31 documents. The court sentenced Abutahir to 20 years rigorous imprisonment and imposed a fine of Rs 50,000 under Section 376(3) of the IPC and Section 4(2) of the Pocso Act. Further, under Article 363, the convict was sentenced to three years simple imprisonment and a fine of Rs 10,000. The court directed that Rs 50,000 of the penalty should be given to the survivor. Moreover, the court has directed the district legal services authority to pay compensation of Rs 1.5 lakh under the victim compensation scheme, the special public prosecutor added.
