Bryan man gets a 40-year prison sentence for aggravated assault on a police officer in 2018

BRYAN, Texas (KBTX) – A Bryan man was convicted and sentenced to 40 years in prison in 2018 for aggravated assault on a charge against a public servant.

During a welfare check on a man on the roadway on Thursday, September 18, 2018, a Bryan Police Department (BPD) officer located the man identified as Earnest Johnson outside the LaSalle Hotel. The officer reported seeing Johnson with drug paraphernalia, according to a news release from the Brazos County District Attorney’s Office.

Johnson ran from the officer as they approached him, tripped and fell. When he got up, he began attacking the officer, a witness for Bryan testified last week. This witness and another bystander held Johnson off the officer until backup could arrive.

“It ultimately took more than five officers to take Johnson into custody,” the district attorney’s office wrote.

In the scuffle, Johnson dislocated the officer’s shoulder to the point that he required surgery and was off work for six months.

The district attorney’s office said Johnson waived his right to a jury trial. Instead, his case was heard alone by Judge John Brick of the 272nd District Court. Johnson testified in his own defense and denied that he broke the law.

He was found guilty on August 27, 2024 and had his sentencing hearing on November 21. There, the state said Johnson had been in prison three previous times for convictions of burglary and intent to commit assault, and failure to comply with the sex offender. registry. These three sentences mean Johnson will spend at least 25 years in prison.

Johnson was ultimately sentenced to 40 years in prison for aggravated assault on a public servant.
