Former President Donald Trump’s lawyer, Joseph Tacopina, has requested a mistrial in E. Trump’s rape case. Jean Carroll, accusing the judge of acting unfairly in favor of Carroll.

The request, submitted Monday morning, says a mistrial should be granted “based on the Court’s pervasive, unfair and prejudicial rulings” and accuses the court of “distorting the evidence in favor” of Carroll and against the former American president.

Federal Judge Lewis A. Kaplan on Monday afternoon denied Tacopina’s request for a mistrial.

A spokesperson for Carroll’s lawyers declined to comment on Tacopina’s mistrial motion when contacted by Insider.

Tacopina’s request alleged that the court “strengthened the testimony” of Carroll and allowed him to avoid clarifying the information on the surveillance cameras.

He also alleged that the number of lawyers at Carroll’s table and the testimony of Natasha Stoynoff, who had previously made an allegation of sexual misconduct against Trump, added to the court’s bias.

Tacopina’s request comes as Carroll testifies in his civil trial against Trump, which is taking place in Manhattan federal court. She accused him of raping her in the dressing room of a Bergdorf Goodman’s department store in the mid-1990s and of defaming her when he called her a liar after she went public with her allegations in 2019.
