The Wisconsin Supreme Court decided Tuesday, July 2, to consider two appeals against a 175-year-old law that conservatives say bans abortion, without letting the cases proceed to lower courts.

Both cases focus on whether the state’s 1849 law actually prohibits abortion and whether abortion is a right protected by the Wisconsin state constitution. The case is being brought in part by Planned Parenthood.

The 2022 U.S. Supreme Court decision on Roe v. Wade led to the activation of Wisconsin’s 1849 law, criminalizing the intentional destruction of the life of an unborn child, excluding the mother.
