The Senate expected to soon announce the resolution on the proposed impeachment of Kenya’s vice president.

This came after the majority of Members of Parliament (MPs) adopted an 11-count impeachment motion that voted to dismiss the vice president, Rigathi Gachagua.

On Tuesday night, National Assembly Speaker Moses Wetangula announced that 282 MPs supported the impeachment motion, while 44 MPs opposed the motion, one MP was neutral.

The speaker of the House did not send the lawmakers’ decision to the upper chamber and lawmakers hope to investigate the allegations against the vice president and defend or reject the impeachment motion.

The combative vice president is accused of corruption, undermining the government and claims he promotes ethnically divisive policies.

If two-thirds of the senators approve the charges, Gachagua will lose his position and will not be able to hold any public office in the future.

Lawmakers accuse Rigathi Gachagua, saying he practices ethnically divisive policies and undermines the government.

They also accuse him of acquiring properties through corrupt means. Dems claim the assets and gada were worth 5.2 billion Kenyan shillings ($40 million, £31 million) in two years, unexplained wealth.

However, the vice president, who is a wealthy businessman, is clear that most of the houses and land belong to his late brother’s estate.

Those supporting the allegations allege that Rigathi Gachagua was involved in the June anti-government demonstrations – which turned deadly.

Additionally, lawmakers wrote 11 charges against the vice president that were presented to the Senate.

Part of the charges include:

  • Serious violation of article 160 (1) of the constitution and the decision-making independence of judges.
  • Serious reasons to believe that the Vice President does not commit crimes under sections 13 (1) (a) AND 62 of the National Cohesion and Integration Act;
  • Serious misconduct by persistent intimidation of public and state officials.
  • Serious misconduct by open or public insubordination to the president, who is the head of state and government

The 59-year-old politician, known as “Riggy G”, does not describe the allegations against him as “outrageous” and “pure propaganda”.

Gachagua does not deny any wrongdoing due to the recent fallout with President William Ruto.

In a televised speech on Monday, he condemned Mwengi Mutuse, the MP who drafted the motion, calling it “shameful and sensational”.

“I am innocent of all these charges,” Gachagua said.

“I have no intention of resigning from this job. I will fight until the end.”

And he defends the controversial renovation of the capital’s official residence.

Gachagua went to court several times to stop the impeachment process, but failed.

On Sunday, Gachagua bin pleaded with President William Ruto and MPs to forgive any wrongdoing during his time in office.

Ruto has never publicly commented on the impeachment movement, but he is on record in the early days of his presidency and said I will not publicly humiliate my deputy.

Steps to impeachment of Kenya’s vice president

For this specific case, a total of 291 deputies, more than the 117 required by the constitution, signed the motion to begin impeachment in early October.

According to the constitution, there are reasons to remove the vice president from office; due to physical or mental incapacity to perform the duties of the position; or about impeachment.

For the constitution of Kenya, in order for lawmakers to impeach or remove the vice president, they must not do the following;

  • At least 45 senators must vote in favor of impeachment charges before they can run for office or remove the vice president.

Who can replace Rigathi Gachagua if the Senate confirms impeachment

According to Kenya’s constitution, within fourteen days the position of vice president becomes vacant, the president will nominate a person to fill the vacancy and the National Assembly will vote on the appointment within sixty days of them receiving the person’s name.
