Georgia Freelancers Call for Dismissal of Contractor Rule Suit

A group of freelance writers and editors in Georgia is asking a federal appeals court to revive their legal challenge to the U.S. Department of Labor’s independent contractor rule.

The appeal to the 11th Circuit Court of Appeals filed Oct. 23 comes after a judge dismissed the lawsuit earlier this month, concluding that the four freelancers had failed to establish standing to sue over the policy.

Georgia Judge Richard W. Story said in his Oct. 7 ruling that because the new independent contractor rule has a “fact-specific approach” that could result in a different classification on a case-by-case basis, freelancers do not can prove it. .
