Texas cop fired for alleged sexual assault, but video shows incident was part of consensual threesome

A Texas police officer was arrested for alleged sexual assault and fired — even though authorities were aware of footage proving the incident was part of a consensual threesome, a new lawsuit claims.

Freddie Douglas, a 43-year-old father of two and former El Campo Police Department “Officer of the Year,” said in court documents that his life was turned upside down in December when Amanda Zawieruszynski, 40, accused him and his longtime boyfriend, John Marks, 41, of raping her.

Zawieruszynski, who lived across the street from Marks and was dating him, claimed the men forced themselves on her as she went to Marks’ home in Manvel, just outside Houston, for a late-night swim on Nov. 8, the suit says — noting that the accuser is white and the men are black.

“She claimed she tried to defend herself against Marks. She claimed he then pushed her towards Douglas who had sex with her as she tried to push him away,” Douglas’ complaint, first obtained by the Daily Mail, states.

But the lawsuit presents a completely different version of events than the alleged victim’s – a scenario it says is confirmed by extensive footage taken on Marks’ home security system and later verified by prosecutors.

“Douglas first met AZ (Zawieruszynski) at John Marks’ home. … It was the day before Freddie Douglas’ birthday. He and John Marks had planned to go to a Rockets game that night,” the complaint states, describing how Zawieruszynski sent Marks several text messages to arrange a ride and a swim upon their return.

After Douglas and Marks returned home, Zawieruszynski came over, they had a few drinks and got into the water, the lawsuit says.

“No one was intoxicated. At some point, John Marks and AZ began to have consensual sex in the pool. After that, AZ wanted to have sex with Freddie Douglas and did so. This sexual activity was entirely consensual on the part of all involved,” the complaint states.

But about a month later, Zawieruszynski turned around and told officers that Douglas and Marks had assaulted her and that they needed to be locked up immediately, the papers said.

On Dec. 7, Douglas was at work when the El Campo police chief approached him and told him he was being arrested by the Manvel Police Department on Zawieruszynski’s accusations, the document states.

Douglas’ lawsuit claims that moment was the first time he or Marks heard anything unusual about the night at the pool and that Manvel officers never questioned him or included him in an investigation before his arrest.

Although he immediately told Manvel police he had video evidence that would exonerate him, Douglas was ignored and thrown behind bars to spend a night in a freezing cell with no blankets, the lawsuit says.

Meanwhile, officers searching Marks’ home were heard on the home security system talking about the footage — but still did not review it and charge the couple, the lawsuit says.

“Within minutes of Freddie Douglas’ arrest, the Manvel Police Department knew there was objective evidence that would determine who was telling the truth, AZ or Douglas and Marks,” the complaint says, adding that no one investigated the footage.

After posting a $100,000 bail with the help of his mother — which included $10,000 in nonrefundable fees — Douglas sold his home and belongings in a “fire sale” to cover his legal fees, according to his complaint.

But his reputation was already tarnished, the documents show.

Douglas, who had worked for the El Campo police force since 2011, saw his name appear on the front pages of his small town’s newspapers, according to court documents.

“As Freddie Douglas moved through the small town of El Campo, the stares and whispers followed him everywhere: to the grocery store, to Walmart, to the gas station, to red lights. In a town like El Campo, if a police officer is arrested and fired without notice by the department, everyone assumes the defendant is guilty,” the complaint reads.

“Only Freddie Douglas’ closest friends and family supported him during this period. The result almost destroyed Freddie Douglas’ morale. His future looked very bleak,” he adds.

Douglas was only saved when he went to the Brazoria County district attorney, who claimed that Manvel police officers had never come to his agency for a charging recommendation — and that if he had been consulted, he would have advised against any charges based on the video evidence, the lawsuit says.

But despite this, police refused to back down, and it was only when prosecutors took the case to a Brazoria County grand jury that the charges were finally dropped, the newspapers note.

According to the lawsuit, Zawieruszynski was never charged with filing a false complaint.

Douglas is now suing the Manvel Police Department and several of its members, as well as Zawieruszynski, for damages for defamation, violation of civil rights and malicious prosecution.

The Manvel Police Department did not respond to The Post’s requests for comment.
