The minor was returning home around 3 pm from his private school in Akash Nagar near National Highway 9 when the incident occurred.

Ghaziabad: A 13-year-old boy on a bike returning from school was knocked down by an allegedly rashly driven bus near Madhuban Bapudham township on Thursday afternoon, police said on Saturday, adding that the driver has been arrested.

When questioned, the bus driver was found to be driving without a license. Article 106 of the BNS was therefore changed to Article 105 of the BNS (involuntary manslaughter not constituting murder). (Sakib Ali/HT Photo)

The police registered a First Information Report (FIR) in the case following a complaint lodged by the victim’s father Sunil Kumar, a resident of Madhuban Bapudham township. The report was initially registered under sections 106 (causing death by negligence), 125(b) (acts endangering life and safety of others) and 281 (rash and negligent driving) of the Bharatiya Nyaya Sanhita at the Madhuban Bapudham police station.

“The bus involved in the accident has also been seized. On questioning, the driver (Mursaleen alias Saleem, a resident of Dhaulana in Hapur district) was found driving without a licence. Thus, Section 106 of the BNS has been converted to Section 105 of the BNS (manslaughter not amounting to murder),” said Abhishek Srivastava, Deputy Commissioner of Police, Kavinagar circle.

The driver was arrested near Madhuban Bapudham locality.

Officers said Mursaleen was driving an empty private bus and had come to the CNG filling station to refuel.

In his complaint lodged with the police on Friday, Kumar said his son was returning home around 3 pm from his private school in Akash Nagar near National Highway 9 when the incident occurred.

“When my son reached a CNG filling station near Madhuban Bapudham, a speeding bus knocked him down and he was crushed under the front wheel of the bus. He suffered serious injuries. One Krishna Kumar called me to inform me about the incident. I reached the spot and rushed my son to Kavi Nagar hospital, but he succumbed during treatment around 6.45 pm,” the father said in the complaint, quoted in the FIR.
